Estonia combines EPR obligations (take-back, recovery targets, PAKIS reporting) with a packaging excise duty as leverage: anyone who joins an accredited Taaskasutusorganisatsioon (recovery organisation – ETO, Eesti Pakendiringlus, TVO) by contract and meets the target rates is exempt from the excise duty. An authorised-representative obligation for companies without an establishment in Estonia already exists under national law – regardless of the sales channel, i.e. stricter than in many EU countries. Deposit-bearing beverage packaging runs through the separate deposit system (Eesti Pandipakend) and is not covered here. National PPWR alignment is under way; ETO expects a PPWR-compliant producer register only around 2028 – until then PAKIS applies.

Packaging EPR: Taaskasutusorganisatsioon & the PAKIS packaging register (Estonia)

A Pakendiettevõtja (packaging undertaking) is anyone who packs goods and places them on the market in Estonia, imports packaged goods into Estonia – or, as a foreign distance seller, delivers directly to Estonian customers. Obligations: registration and annual volume reporting in the PAKIS packaging register, fulfilment of the take-back and recovery targets (in practice by contract with an accredited Taaskasutusorganisatsioon), and, from 20 t/year, an audit of the packaging data.

Authorised representative
Under the Pakendiseadus, a Pakendiettevõtja WITHOUT an establishment in Estonia that commercially places packaging on the market there – regardless of the sales method – must appoint a volitatud esindaja (authorised representative) established in Estonia who takes over the statutory obligations. The authorisation is effective only with the representative's written acceptance; the representative's details must be reported to the packaging register. A Taaskasutusorganisatsioon can also act as the authorised representative. Since 12 Aug 2026 the PPWR authorised-representative obligation (Art. 45) additionally applies for distance selling.
Cross-border
Foreign online sellers delivering directly to Estonian end customers are expressly covered as Pakendiettevõtja and – unlike in many countries even before the PPWR – always need an authorised representative in Estonia. Very small volumes: anyone placing less than 25 kg of plastic packaging AND less than 50 kg of packaging of other materials on the market per quarter is largely exempt from the excise duty and the recovery/reporting obligations, but must continue to document the volumes to be able to prove that the thresholds are not exceeded. Breaches of the Pakendiseadus can, according to the Ministry of Climate, be punished with fines (within the misdemeanour framework up to €200,000) and a penalty payment (€32,000).
Costs
Fees of the Taaskasutusorganisatsioonid according to their price lists (material- and volume-dependent; not centrally published). With a contract and target fulfilment, the packaging excise duty does not apply (see the separate obligation ee-packaging-excise).
Deadlines
Registration before starting the activity; annual report of the previous year's data in PAKIS by 31 March (for the first time including single-use plastic data by 31 Mar 2025 for 2024). Legislative amendment including extended SUP rules and the obligation to hold a written TKO contract for sales packaging in force since 17 Jan 2026.

Typical steps

  1. Determine which packaging (sales, grouped, transport and shipping packaging) is placed on the market in Estonia and whether the quarterly thresholds (25 kg plastic / 50 kg other materials) are exceeded.
  2. Choose an accredited Taaskasutusorganisatsioon and conclude a written contract: ETO, Eesti Pakendiringlus or TVO (it takes over the recovery targets and, as a rule, the reports).
  3. Without an establishment in Estonia: appoint a volitatud esindaja in writing and have them recorded in the packaging register.
  4. Ensure registration in the PAKIS packaging register (or have it handled via the TKO/authorised representative).
  5. Record packaging volumes per material; report the previous year's annual data by 31 March (as a rule via the Taaskasutusorganisatsioon).
  6. From 20 t of packaging per year: arrange an audit of the packaging data by a sworn auditor.
  7. File evidence of the registration/TKO membership with the marketplaces you use.

Packaging excise duty (Pakendiaktsiis) – exemption via a Taaskasutusorganisatsioon (Estonia)

A packaging excise duty is levied on packaging placed on the market in Estonia (e.g. €2.50/kg for plastic). It does not apply if the Pakendiettevõtja transfers its recovery obligations by written contract to an accredited Taaskasutusorganisatsioon and the target rates are met – or if volumes remain below the small-volume thresholds. Anyone without an exemption must declare and pay quarterly.

Authorised representative
For the excise duty, the same structures apply as for the EPR obligation: companies without an establishment in Estonia act via their volitatud esindaja or their Taaskasutusorganisatsioon, which secures the exemption (see ee-packaging-epr).
Cross-border
Foreign distance sellers are also liable to the excise duty as Pakendiettevõtja if no exemption applies. The practical route: conclude a TKO contract via the authorised representative, and the excise duty does not apply. Small-volume exemption: below 25 kg of plastic per quarter AND below 50 kg of other materials per quarter. Note: since 1 May 2023 the excise exemption no longer automatically exempts from the other obligations of the Pakendiseadus.
Costs
Excise rates per kg (due only without an exemption or where the targets are missed): glass €0.60, plastic €2.50, metal €2.50, paper/cardboard €1.20, wood €1.20. With a TKO contract and target fulfilment: €0 excise duty, but TKO fees instead.
Deadlines
Excise declaration per taxable period (quarter) by the 15th of the following month. Recovery target rates were raised as of 1 Jan 2025 (including plastic 50%, paper/cardboard 75%).

Typical steps

  1. Check whether an exemption applies: a TKO contract with target fulfilment, or small volumes (below 25 kg plastic and 50 kg other materials per quarter).
  2. Without an exemption: declare and pay the excise duty quarterly to the EMTA (Estonian Tax and Customs Board) by the 15th of the following month.
  3. Keep packaging records to be able to evidence the exemption or the assessment basis.
