Beverage packaging is largely excluded from S.L. 549.43 via the Beverage Containers Recycling Regulations and runs through the BCRS deposit return scheme. For the period since 12 Aug 2026, the ERA officially refers to the PPWR together with the Commission guidance and FAQ; the national producer register was last updated on 27 Aug 2026. The ERA also provides a mandate form for authorised representatives under S.L. 549.43.

Packaging EPR (Malta)

Anyone placing packaging or packaged goods on the market in Malta for the first time (including as an importer or online seller) must register with the ERA as a Producer of Packaging before market launch (Form G), renew the registration annually (Form H) and fulfil the recovery obligations via an authorised scheme (GreenPak or Green MT) or through audited self-compliance. Below 100 kg/year a simplified declaration procedure applies.

Authorised representative
Since 12 Aug 2026, Art. 45 PPWR requires, for distance selling into Malta without an establishment there, an authorised representative established in Malta. The ERA provides a dedicated form for this ('Written Mandate declaration for an Authorised Representative' under S.L. 549.43), by which the mandate is declared to the authority.

  5. Alternatively self-compliance: work plan and compliance audits under the ERA terms of reference (relief with certified ISO 14001/EMAS environmental management).
  6. Small-volume rule: at ≤ 100 kg/year, a simplified declaration ('less than 100 kg' form) instead of the full producer obligations; according to industry guides this registration ends automatically after 3 years without volumes.
  7. Show the ERA registration number visibly on invoices/receipts in accordance with S.L. 549.43 (according to EPR guides).
  8. Without an establishment in Malta: appoint an authorised representative and submit the ERA mandate form (PPWR Art. 45).
  9. Check beverage packaging separately: BCRS deposit return scheme instead of S.L. 549.43.
