Decreto-Lei n.º 152-D/2017 (UNILEX, the extended producer responsibility regime for specific waste streams, consolidated inter alia by DL n.º 102-D/2020): Art. 19.º registration obligation in SILiAmb/SIRER (the APA producer register) before placing on the market; Art. 20.º obligation for foreign distance sellers to appoint a representante autorizado (authorised representative) in Portugal.

For packaging (SIGRE), three entidades gestoras (licensed producer responsibility organisations) are licensed: Sociedade Ponto Verde, Novo Verde and Electrão (SPV licence conditions effective from 1 Jan 2025); they cover household (fluxo urbano) and non-household packaging (fluxo não urbano). There are also special schemes (VALORMED for pharmaceutical packaging, VALORFITO for agricultural packaging). The APA has been running information events on the PPWR since 2026; according to the APA presentation of 15 May 2026, Arts. 44–47 PPWR (register, EPR, organisations) still require national implementation steps. Since 1 Jan 2026, new criteria for determining the Ecovalor (eco-fee) and a new declaration model apply.

Packaging EPR (Portugal)

Anyone placing packaged goods on the market in Portugal for the first time (Embalador (packer)/importer, including shipping packaging in online retail) must register in the APA producer register SILiAmb before placing goods on the market, report volumes annually by 31 March and fulfil the EPR obligations via a licensed entidade gestora (Sociedade Ponto Verde, Novo Verde or Electrão) against payment of the Ecovalor. The registration number (PTxxxxxx) must be stated on invoices and transport documents.

Why does this affect me cross-border?
Foreign online sellers making direct sales to Portuguese end customers are themselves subject to EPR and can complete the SILiAmb registration only via their representante autorizado (APA manual 'Registo de Produtores estrangeiros através de Representante Autorizado'). Without registration there is a risk of sanctions; according to its PPWR communications, the APA is increasingly relying on cooperation with online platforms to identify unregistered producers.
