Packaging obligations in Slovakia (2026)

The PPWR alignment amendment to the Waste Act was not in force as at 12 Aug 2026. The Ministry of Environment (MŽP SR) clarified by Usmernenie No. 46177/2026 of 4 Aug 2026 (guidance): since 12 Aug 2026 the producer definition follows the PPWR directly (the national definition in § 52 ods. 11 recedes to that extent), while the national EPR system – register, OZV contracts, reports, fees – continues to run unchanged.

Packaging EPR (Slovakia)

Anyone placing packaged goods on the market in Slovakia – including by cross-border delivery to Slovak end customers – counts as a packaging producer (výrobca obalov), must be entered in the Register výrobcov obalov before market launch and fulfil their obligations collectively via an authorised producer responsibility organisation (OZV). The system covers household and commercial packaging regardless of channel.

Authorised representative: 
Producers without a seat or establishment in Slovakia must, under § 27 of zákon č. 79/2015, appoint in writing a splnomocnený zástupca (authorised representative) with a seat in Slovakia (mandate of at least 1 year); registration in the Register výrobcov takes place through them, and they assume the producer obligations in their own name. In addition, Art. 45 PPWR has required an authorised representative since 12 Aug 2026 for distance selling into Member States without an establishment of your own.
Cross-border: 
Foreign online sellers who transport (or have transported) goods in packaging across the state border into Slovakia and place them on the market there already fell under § 52 ods. 11 písm. c) of the Waste Act; since 12 Aug 2026 the PPWR producer definition (including distance selling) applies directly. Without registration, listing blocks are a risk, as marketplaces check EPR registrations per country.
Costs: 
Fees according to the tariff of your chosen OZV (material- and volume-dependent); tariff information directly from the OZV.
Deadlines: 
Registration before placing goods on the market; quarterly reports to the OZV per the contract (customarily by the 10th day after the end of the quarter); the PPWR authorised-representative obligation (Art. 45) has applied since 12 Aug 2026. The national PPWR amendment was still pending as at the review date.

Typical steps

  1. Check whether goods in packaging (including shipping packaging) are placed on the market in Slovakia – if so, producer status (výrobca obalov) applies.
  2. Without a seat in Slovakia: appoint a splnomocnený zástupca in writing (seat in Slovakia, mandate of at least 1 year); registration runs through them.
  3. Before placing goods on the market, apply for entry in the Register výrobcov obalov at the MŽP (form 'Žiadosť o zápis do registra výrobcov' in the ISOH waste information system).
  4. Conclude a contract with an authorised OZV for packaging – 9 authorised OZVs, including ENVI-PAK, NATUR-PACK, SEWA, Reclay Systems s.r.o. (official list in the ISOH).
  5. Keep internal packaging records (§ 27 ods. 12) and submit quarterly reports to the OZV (customarily by the 10th day after the end of the quarter); with OZV membership, the OZV takes over the annual Ohlásenie (report) to the MŽP (vyhláška č. 366/2015).
  6. Check the small-volume rule: below 100 kg of packaging/year no OZV contract is needed – but registration, ongoing records and the annual Ohlásenie to the MŽP remain mandatory.
  7. Document EPR registration evidence for the marketplaces you use.
