Packaging obligations in Slovenia (2026)

Slovenia is in the middle of an EPR reform: ZVO-2 provides for a single non-profit PRO organisation per waste stream, and implementation has been delayed by, among other things, a constitutional review. According to the Ministry's clarification of April 2026, the transition is taking place in stages; full operation of the new system (cost coverage by producers) is expected only around 2028. Until then, the existing DROE system under the Uredba continues to apply – currently 7 companies, whose take-over shares the government sets quarterly.
Packaging EPR (Slovenia)
Anyone placing packaging on the market in Slovenia – expressly including foreign companies selling packaged goods by distance selling directly to Slovenian end users – must be entered in the Evidenca proizvajalcev (producer register) at the Environment Agency ARSO, report volumes and ensure waste management via a DROE (družba za ravnanje z odpadno embalažo, packaging waste management company) or an approved individual system. There is no de minimis threshold for registration.

- Producers that are a 'tuje podjetje' (foreign company) must, under čl. 29(5) of the Uredba, appoint by written power of attorney a pooblaščeni zastopnik (authorised representative) with a seat in Slovenia (definition in čl. 3 t. 28); this representative completes the registration and fulfils the PRO obligations. In addition, since 12 Aug 2026 the authorised-representative obligation under Art. 45 PPWR applies for distance selling without an establishment.
- Cross-border:
- The producer definition (čl. 3 t. 36) expressly covers foreign companies selling packaged goods via means of distance communication directly to end users in Slovenia – regardless of channel. For them, entry in the Evidenca proizvajalcev must be made via the pooblaščeni zastopnik. Below 1,000 kg of packaging/year, a flat-rate cost contribution is possible (čl. 31(5)); this does not exempt from registration and the scheme obligation.

- Embalažnina (packaging fee) per the DROE contract (material- and volume-dependent, no uniform public tariffs); below 1,000 kg/year a flat-rate cost contribution is possible (čl. 31(5) of the Uredba).

- Entry within 30 days of starting the activity; the government sets the DROE take-over shares quarterly by Sklep (decision) (most recently for Q3 2026); PPWR authorised-representative obligation since 12 Aug 2026; a ZVO-2 amendment for PPWR alignment was in progress with a deadline of 13 Aug 2026.
Typical steps
- Check whether producer status applies (packer, importer of packaged goods, manufacturer of service packaging – or foreign distance seller under čl. 3 t. 36).
- Without a seat in Slovenia: authorise in writing a pooblaščeni zastopnik with a seat in Slovenia (mandatory under čl. 29(5)).
- Register in the Evidenca proizvajalcev via the ARSO application 'Embalaža' within 30 days of starting the activity (čl. 14).
- Conclude a contract with a DROE (currently 7 companies: Slopak, Interzero, Dinos, Surovina, Recikel, Embakom, Tisa) or set up an individual system under čl. 32.
- Keep ongoing volume records; report volumes to the DROE per the contract (the DROE reports to ARSO); in an individual system, report electronically to ARSO following its instructions.
- Monitor the EPR reform: the transition to the new PRO organisation under ZVO-2 (full operation expected around 2028) may change contract and reporting channels.
